Entrants

Players must be 16 years or over. By entering the competition, all entrants are deemed to have accepted and agreed to abide by these rules.

Employees of the promoter or any associated companies, and members of their families, are not eligible to enter.

Entrants can enter the competition only as specified in these terms and conditions.

Winners will be expected to provide the promoter with the form of proof of identity as the promoter in its sole discretion requests.

Failure to comply with any of these terms and conditions will disqualify any entrant from taking part in the quiz and the promoter retains sole discretion to refuse entrants the right to enter if it feels that these terms and conditions are being broken.

Entries

The LOWEST UNIQUE bid by the closing date is the winning bid

The winner is obliged to pay the amount bid within 14 days of receiving notification that they are the winning bid.

In the event of there being no unique bid, a tie-break will be set.

Bids must be in UK sterling in pence and must be a whole number. For example you may bid 28 for 28p but you cannot bid 28.5 for 28.5p.

Each bid costs £1.50.

Closing date for the Competition is 8pm 28th February 2006.

The promoter is not responsible for any network delays that cause the returning text to be postponed. The date stamp on the text message is the date and time the bid was logged in our system and this date and time will be used in all circumstances.

Winners list available 14 days after closing date.

All entries must be received before the closing date. The Winner of the competition will be notified by within 14 days.

Any entry made giving another person's (or a false) name will be disqualified.

Prizes

There is one first prize in the competition. The prize is a new Nokia N91.

If as a result of circumstances beyond the control of Keep Talking and it is impossible to provide the offered prize, cash may be given as an alternative at the sole discretion of Keep Talking.

The prize is non-refundable and cannot be transferred.

The promoter shall not be liable in any way for any failure or breach by any party in connection with this competition, prize or prizes and accepts no responsibility for any loss suffered by an entrant arising from this competition.

In all cases the promoter will not be held liable for a prize that do not reach the winners for reasons beyond its control.

Publicity and Personal Data

By entering the competition, the winner agrees to the use of their name or likeness, without compensation, for promotional purposes. Winners will be expected to take part in any PR activity reasonably requested by the promoter.

Property

You acknowledge that the promoter or third-parties own all right, title and interest in and to this service, portions thereof, or other software and or services provided through or in conjunction with this service or software, including without limitation all Intellectual Property Rights.

"Intellectual Property Rights" means any and all rights existing from time to time under patent law, copyright law, trade secret law, trademark law, unfair competition law, and any and all other proprietary rights, and any and all applications, renewals, extensions and restorations thereof, now or hereafter in force and effect worldwide.

No personal information is passed or disclosed to any external body corporate or private, save as required by Law or regulation. We will ALWAYS respect your privacy and wishes.

Miscellaneous

Entrants indemnify the promoter its agents, employees, representatives, associates, affiliates, parent and subsidiary companies against any and all claims, losses, costs, damages, liability and expenses arising out this competition, prize or these terms and conditions.

Each entrant by entering this competition, expressly releases the promoter from any claim, action or demand arising out of or in connection with the competition or their prize, if any.
